No more tourist visa for commissioning surrogacy in India: Home Ministry

Foreign nationals intending to visit India for commissioning surrogacy will not be allowed to come on a tourist visa from Friday with the Home Ministry ordering strict adherence of surrogacy laws.

In an order, the Home Ministry said several instances of foreign nationals visiting India on tourist visa for commissioning surrogacy have been reported and no such relaxation would be allowed after November 1. "This is (tourist visa) not the appropriate visa category and such foreigners will be liable for action for violation of visa conditions. The appropriate visa category will be a medical visa," the order said.

The Ministry said it is also necessary in such cases to ensure that the surrogate mother is not cheated and therefore, such a visa may only be granted if certain conditions are fulfilled. The conditions include that the foreign man and woman are duly married and the marriage should have sustained at least for two years.

A letter from the embassy of the foreign country in India or the Foreign Ministry of the country should be enclosed with the visa application stating clearly that the country recognises surrogacy and the child/ children to be born to the commissioning couple through the Indian surrogate mother will be permitted entry into their country as a biological child/ children of the couple commissioning surrogacy.

The couple will have to furnish an undertaking that they would take care of the child/ children born through surrogacy, the treatment should be done only at one of the registered Assisted Reproductive Treatment (ART) clinics recognised by Indian Council of Medical Research.

Besides, the couple should produce a duly notarised agreement between the applicant couple and the prospective Indian surrogate mother. "If any of the above conditions are not fulfilled, the visa application shall be rejected," the Home Ministry said.

The Ministry also told Indian missions abroad that before the grant of visa, the foreign couple need to be told that before leaving India for their return journey, "exit" permission from the Foreigner Regional Registration Offices/ Foreigner Regional Registration Offices (FRRO/FRO) would be required.

Before granting "exit", the FRRO/ FRO will see whether the foreign couple is carrying a certificate from the ART clinic concerned regarding the fact that the child/ children have been duly taken custody of by the foreigner and that the liabilities towards the Indian surrogate mother have been fully discharged as per the agreement.

A copy of the birth certificate(s) of the surrogate child/children will be retained by the FRRO/ FRO along with photocopies of the passport and visa of the foreign parents.

"It may be noted that for drawing up and executing the agreement, the foreign couple can be permitted to visit India on a reconnaissance trip on tourist visa, but no samples may be given to any clinic during such preliminary visit," the order said.

Panel wants immediate hike in diesel, LPG prices

Seeking to set a roadmap for reforms in the petroleum sector and systematically eliminate subsidies, the government appointed Kirit Parikh Committee on Wednesday strongly recommended an increase of Rs. 5 per litre in price of diesel, a Rs. 4 per litre in kerosene and Rs. 250 increase in LPG cylinder with immediate effect.

It also recommended that the limit for subsidised LPG cylinders be reduced from present 9 to 6 cylinders per annum to each household. It also has pitched for capping the subsidy on diesel at Rs. 6 per litre while giving a call for elimination of subsidy on diesel within one year which could save the exchequer Rs. 72,000 crore in fuel subsidy, Mr. Parikh told reporters while submitting the report to Petroleum and Natural Gas Minister, Veerappa Moily here.

However, the recommendations of the panel are unlikely to be implemented as the proposals will have to be endorsed by the Union Cabinet. With Assembly elections in five States scheduled in the next two months, it is unlikely that the report will see the light of the day any time soon. The Kirit Parikh panel was set up by the Petroleum and Natural Gas Ministry to suggest a methodology for pricing of diesel and cooking fuel.

Stating that government has already decided to eventually free diesel price, it said Government should take steps to pass on the impact of rise in price of diesel to consumers and move rapidly towards making the price of diesel market determined. ``The expert group recommends that in view of high under-recovery of Rs. 10.51 per litre on diesel, HSD prices raised by Rs. 5.00 per litre with immediate effect. The balance under-recovery should be made up through a subsidy of Rs. 6 per litre to public sector oil marketing companies (OMCs). The subsidy on diesel should be capped at Rs. 6 per litre litre. This would imply freeing of price of Diesel beyond this cap,’’ the report states.

It said if the gap falls below Rs. 6 per litre, either the prices should be reduced or the subsidy to be provided should be reduced. In the future, OMCs should be permitted to revise the prices above the subsidy cap on their own. The fixed subsidy of Rs. 6 per litre be reduced gradually and finally removed through regular revisions over the next one year, it states.

Similarly, it said PDS kerosene price should be comparable to diesel price to prevent diversion and adulteration. ``This can be accomplished if PDS kerosene is priced at full market price and the benefit of the subsidy to the deserving consumers i.e. BPL families, is given through direct cash transfer mechanism. ``The direct transfer of subsidy to BPL families country-wide should be fast-tracked and completed within the next two years. Till this is implemented, price of kerosene should be increased by Rs. 4 per litre immediately and thereafter be revised from time to time at least in line with growth in the per capita agriculture GDP.

In view of the Rs. 555.44 subsidy per LPG cylinder, the panel said the number of cylinders should be reduced from the present 9 to 6 cylinders. The price of LPG cylinder should be hiked by Rs. 250 immediately and the balance subsidy be phased out over the next 2 years through gradual price increase.

Tendulkar's gloves to be displayed in exhibition

Sachin Tendulkar's gloves which he wore while scoring his 100th international century will be displayed in an exhibition, featuring rare and historically significant memorabilia of Indian cricket, on November 15.

The organisers, Tata Literature Live! The Mumbai LitFest 2013, has planned a tribute for Tendulkar who will retire from Test cricket after playing his landmark 200th match here from November 14-18.

"A special section of the presentation would be dedicated solely to Tendulkar, and will carry the priceless gloves with which he scored his 100th century among other things," it said in a statement.

The event will bring forth a unique collection of artefacts, pictures and other memorabilia dating back to over a century, and the memorable moments in the history of Indian cricket.

It will also display items such as a letter from a first class cricket ball maker giving the rates of a ball, another from a Maharaja to CK Nayadu and the 1983 World Cup stamp.

"That apart, the exhibition will be a window to the lives and times of Indian cricketers of the yore through postcards, souvenirs, stamps and framed photographs," it said.

Abhishek Bachchan promotes Dhoom: 3 despite injury

Despite hurting himself recently, actor Abhishek Bachchan is working hard to promote his forthcoming film "Dhoom 3".

The actor injured himself while working out Monday and ended up having a torn tendon in his elbow.



"He attended an event yesterday (Tuesday) and was also present the 'Dhoom 3' trailer launch today (Wednesday)," a source close to the actor told IANS.

The 37-year-old has not taken any kind of break from working gyming sessions.

“Abhishek is still working out. He is doing light weights at the moment. He is not taking it easy at all,” the source added.

"Dhoom 3", produced by Aditya Chopra, will release Dec 20 and it will see Aamir Khan in a negative role.

The third instalment in the "Dhoom" series, which created 'dhoom' in 2004 with high voltage action and sleek presentation, also stars Katrina Kaif and Uday Chopra.
